The 'Fair Use' Rule: When Use of Copyrighted Material Is Acceptable
In some situations, you may use another person or entity's copyrighted work without asking permission.
Copyright Fair Use of copyrighted material for Criticism Purposes
Uses That Are Normally Considered Legally "Fair"
Criticism and commentary: For example, quoting or excerpting a work in a review or criticism for purposes of illustration or comment would normally be fair use. A book reviewer would be permitted to quote passages from a book in a newspaper column as part of an examination of the book.
There are several factors that a court will consider when determining whether an instance of infringement qualifies as fair use. Non-commercial use weighs heavily in favor of finding that the infringement is fair use. Violations often occur when the use is motivated primarily by a desire for commercial gain. The fact that a work is published primarily for private commercial gain weighs against a finding of fair use.

ADDENDUM
Please note that in linking back to a website I am not copying ANYTHING at all. I am giving my opinion which is my intelectual property. Then providing a link so the person can see what I an referring to-nothing more. So in such cases, no copyright infringemet has occurred just reference to a work posted at another site and my opinion about it. If indeed that were infringement, then providing an opinion on any poet's work would be infringement. That would limit what could be said about any writer's work to a ridiculous degree.
Furthermore, linking to that site will significantly increase their viewer trafic and membership. So instead of furiously trying to stop me, they should be thanking me for this free adverising service which can potentially expose their site to hundreds of viewers per day. SMH
