When does Self-Defense become Murder?
Just recently, on Twitter, someone posted a video of this male suddenly attacking a female. During the brief struggle, the male was easily slammed to the floor, and then the female began kicking him on the head and face. Now, there are those who said that she had a right to defend herself. Of course, that is beyond a doubt. If attacked, we definitely do have are right to defend ourselves.
However, there are certain limits. You see, there is this concept called the application of excessive force which we must take into considered when evaluating the force being used was justifiable or not. If we do not, then we can easily mistaken unnecessary manslaughter or murder as justifiable self-defense.
For example, imagine that someone attacks you with a knife and you shoot and drop him. He is lying on the floor incapacitated. Now you stand over him and pump more bullets into him. That will not be considered self defense.
Or else a person attacks us and we manage to get him in a choke hold. He has lost consciousness due to lack of oxygen goes limp and is motionless. Yet, we continue to add pressure for sixteen minutes until he is brain-dead. This actually happened recently and it was deemed murder in a court of law.
So the same applies if we continue to kick someone on the head after the person is down. Could we have straddled or restrained him instead? I the case of the female in question who looked physically bigger and stronger than the man, this was definitely a choice. Instead, as the fellow was subdued, one potentially lethal kick followed another, and only the intervention of a bystander prevented permanent brain damage or death. So if ether brain damage or death would have occurred, it would have definitely not been deemed justifiable self-defense.
