That depends on the details of the physician's conduct and his assistants.

Yes, so much is truly relative. No, it isn't such a lofty concept as to be classified as either a polished or a rough-hewn a revelation. Actually, I am surprised by your reaction since it is fairly common knowledge that medical malpractice comes in different categories and different intensities. It can range from withholding common courtesies to outright blatant cruelty via inflicting unnecessary physical pain, as well as psychological trauma via verbal assault.
For example, there was this black woman who under general anesthesia that didn't fully take, happened to overhear the surgeons and nurses criticizing her body and making jokes in reference to it. Saying that she was offended over a trivial matter is just plain silly.

Trivial matters should not be taken to court. Judges are very quick to dismiss such cases. Also, a good lawyer will not take such a case but will advise the person that he is being oversensitive. If a lawyer does cooperate he will wind up looking unprofessional and foolish. His record will also suffer from a loss. That happened to a foolish woman who foolishly took me to court over a foolish matter. However, her lawyer found out it was foolish at the trial and was exceedingly angry after he lost the case when the truth came to light.
